Patient’s rights
The Health Act for promoting and coordinating health, drafted on April 18, 1989, defines the main principles applicable to the health sector and sets the health policy standards. Here are excerpts from some Articles::
Article 5: “…every person is entitled to receive scientifically recognised health care”.
Article 6: “…… every heath care operator, to the extent of his or her professional area, must inform the patient about the diagnosis, the treatment plan, the possible risks, as well as any scientifically recognised alternative treatment. Such information must be provided in a clear and understandable way …”.
Should the patient be mentally incompetent, such information must be conveyed to that person’s legal ward or, secondarily, to the people present or taking care of the patient.
The patient, upon written request, as established by Article 67 cpv4, is entitled to read the objective section of his or her medical records and obtain a copy thereof. He or she may request correction of any mistake in the data or information of concern. The health care professional, in his turn, must inform or make available to the patient the information collected through third parties.”.
Article 7: “…the informed consent of the patient is necessary for the provision of any health care treatment”.
Article 9: “…a mentally competent patient may at any time interrupt a treatment, reject health care or ask to be discharged from the hospital structure, after signing a specific form”.
Patients have the right to ask to remain anonymous at the patient reception service, or to limit or prohibit visits or incoming calls.
All health and administrative staff must comply with professional confidentiality”.
Clarifications and claims
Every patient has the right to ask for clarifications or lodge claims, at any time, turning to the Ward Head, Mr. Alessandro Dell’Avo for issues related to the general ward, and Mrs. Paula Deelen for the Intensive Care ward.
For extremely severe situations, it is possible to turn directly to the Medical Management, to Prof. Dr. Tiziano Cassina and the Administrative management, Mr. Massimo Manserra.
